Court of Appeal gives boost to opt-out collective proceedings in CAT

On 25 July 2023, the Court of Appeal handed down a judgment which is likely to make it easier for opt-out collective actions to proceed in the CAT. Its judgment (here), which also dealt with significant procedural points, followed from an appeal by the Proposed Class Representatives (“PCRs”), challenging the Competition Appeal Tribunal’s (“CAT”) judgment of 31 March 2022 (see our previous briefing on the CAT’s judgment here). This appeal addressed four key issues.
