Clifford Chance advises Sanity Group on entering the European market for cannabis-based products

International law firm Clifford Chance has advised the Berlin-based start-up Sanity Group GmbH comprehensively on entering the European market for cannabis-based products. Sanity Group had recently received the highest investments ever awarded in Europe to an enterprise active in this product area.

The Sanity Group and its affiliates develop and market cannabis-based medicinal and wellbeing products. Sanity Group is backed by the well-known investors Holtzbrinck Ventures, Cherry Ventures, Atlantic Food Labs and Calyx as well as by several prominent private investors, including US musician Snoop Dogg and Justin Bieber producer Scooter Braun.

The legal framework in Europe for the marketing of cannabis and cannabis-based products has been liberalised in recent years. Various health products and consumer goods can now be produced from the various components of the cannabis plant.

Despite a far-reaching European harmonisation of the legal framework for the relevant product categories, the EU member states still provide partly different regulations on marketability and on possible consequences under criminal and administrative law for the production of and trade in such products. This creates high demand for legal advice for enterprises on the relevant legal requirements in Europe.

With its international Healthcare & Life Science practice, Clifford Chance has been one of the first firms in Europe to offer regulatory advice on the liberalised European market for cannabis-based products. Today, the team around partner Gunnar Sachs is successfully advising clients from almost all sectors on the new European market for cannabis-based products. Clients include well-known health care, consumer goods and retail corporates as well as financial investors, leading global banks and online payment services. Among other aspects, these firms are looking into the extent to which they may offer financial services in connection with the sale of cannabis-based products in Europe.

Das Unternehmen hatte zuletzt die höchsten Investitionen erhalten, die je in Europa für ein in diesem Produktbereich tätiges Unternehmen vergeben wurden.

Die Sanity Group entwickelt und vermarktet mit ihren Tochterunternehmen Cannabis-basierte Pharma- und Wellbeing-Produkte.

Hinter der Sanity Group stehen die bekannten Kapitalgeber Holtzbrinck Ventures, Cherry Ventures, Atlantic Food Labs und Calyx sowie mehrere prominente Privatinvestoren, darunter der US-Musiker Snoop Dogg und Justin Bieber-Produzent Scooter Braun.

Die rechtlichen Rahmenbedingungen für die Vermarktung von Cannabis und Cannabis-basierten Produkten wurden in den vergangenen Jahren in Europa liberalisiert. Aus den Bestandteilen der Cannabis-Pflanze dürfen inzwischen verschiedene Gesundheitsprodukte und Konsumgüter hergestellt werden.

Trotz einer weitgehenden europäischen Harmonisierung der rechtlichen Rahmenbedingungen für die maßgeblichen Produktkategorien gibt es in den Mitgliedstaaten zum Teil noch sehr unterschiedliche Regelungen zur Verkehrsfähigkeit und zu möglichen straf- und ordnungswidrigkeitsrechtlichen Konsequenzen für die Herstellung von und den Handel mit solchen Produkten. Das verursacht für Unternehmen erheblichen Beratungsbedarf zu den in Europa jeweils einschlägigen rechtlichen Anforderungen.
