Clifford Chance advises financiers on the new Breda courthouse PPP project as it reaches financial close

On 30 June 2015 the Rijksvastgoedbedrijf and consortium InBalans reached Financial Close on the Breda Courthouse PPP project. Clifford Chance acted as legal advisor to the financiers on this project.

The DBFMO contract (design, build, finance, maintain and operate) for the construction of new housing and technical facilities for the court Zeeland-West-Brabant, the district public prosecutor Zeeland-West-Brabant and the Raad voor de Kinderbescherming Southwest Netherlands has a term of 30 years. Construction is planned to start in 2016, and the building is expected to be operational in 2018.

The InBalans consortium consists of VolkerWessels, Facilicom and Macquarie Capital. The funding for this project is being provided by BNG, SMBC and MEAG. The project value amounts to EUR 110 million.

The Clifford Chance core team that advised the financiers consisted of Nanette Rutgers, Hein Tonnaer, Willem-Jan Wieland and Ellen Romkens. Other team members were Jaap Koster, Mike Niekoop and Kim Booij, with Robert Masman and Alexander Freud advising on the hedge arrangements and David Woolmer on the English law aspects.
