BVMed publishes first European Compliance Standard in close cooperation with Clifford Chance
In close cooperation with international law firm Clifford Chance, the German Medical Technology Association (BVMed) has published the first European Compliance Standard for the MedTech sector. The new standard outlines the key elements required for an adequate compliance setup and offers companies practical tips and suggestions. It was initially published in October 2021 and is now also available in English. The Compliance Standard is internationally applicable, as it is not only derived from German regulations, but is based on international compliance standards and benchmarks.
BVMed is the industry association for more than 230 industrials and corporates from the MedTech sector in Germany. Its members include the world's 20 largest medical device manufacturers in the consumer goods sector and it is the largest association of its kind in Europe.
Organisational frameworks to prevent companies from breaching compliance regulations have become increasingly important in recent years. The case law shows that one of the key due diligence requirements incumbent on managers is to take adequate steps to control compliance risks. This is where the BVMed Compliance Standard comes in. It contains practical advice and checklists for establishing a compliance setup and tips for performing internal compliance system audits.

In Germany, the medical devices code – which Clifford Chance also helped to develop – has been in place since the end of the 1990s. It summarises the relevant legal provisions to be observed in interactions between medical institutions, doctors and medical device manufacturers. The BVMed Compliance Standard supplements this by covering the organisational aspects.

Die internationale Anwaltssozietät Clifford Chance hat den Bundesverband Medizintechnologie (BVMed) bei der Erarbeitung des "BVMed-Compliance-Standards" für die Medizintechnologiebranche beraten. Der neue Standard beschreibt die wesentlichen Elemente einer geeigneten Compliance-Organisation und gibt Unternehmen dazu praktikable Vorschläge und Hinweise an die Hand.
Der BVMed vertritt als Wirtschaftsverband über 230 Industrie- und Handelsunternehmen der Medizintechnologiebranche. Im BVMed sind unter anderem die 20 weltweit größten Medizinproduktehersteller im Verbrauchsgüterbereich organisiert, und er ist der größte Verband der Branche in Europa.
Die organisatorischen Rahmenbedingungen zur Verhinderung von Compliance-Verstößen in Unternehmen haben in den vergangenen Jahren an Bedeutung gewonnen. Nach der Rechtsprechung gehört es zu den Sorgfaltspflichten der Unternehmensleitung, angemessene Maßnahmen zur Kontrolle von Compliance-Risiken zu ergreifen. An diesem Punkt setzt der "BVMed-Compliance-Standard" an. Er enthält praktische Hinweise und Checklisten für den Aufbau einer Compliance-Organisation sowie Praxistipps zur Selbstüberprüfung durch ein internes Compliance-System-Audit. Der Compliance-Standard orientiert sich an den einschlägigen gesetzlichen Vorgaben zu den Sorgfaltspflichten der Unternehmensleitung (§ 43 GmbHG, § 93 AktG, § 130 OWiG), deren Auslegung durch die Rechtsprechung sowie an nationalen und internationalen Standards und Benchmarks.
BVMed-Geschäftsführer Dr. Marc-Pierre Möll: "Dieser praktische Leitfaden ist der erste Compliance-Standard eines europäischen Medizinprodukteverbands. Neben dem geltenden Recht und dem Kodex Medizinprodukte ist er die wesentliche dritte Säule, auf deren Grundlage ein Medizinprodukte-Unternehmen die Zusammenarbeit mit medizinischen Einrichtungen rechtssicher ausgestalten kann." Den Kodex Medizinprodukte, bei dessen Erstellung Clifford Chance ebenfalls unterstützte, gibt es bereits seit Ende der neunziger Jahre. Er fasst die verhaltensbezogenen Rechtsvorschriften zusammen, die bei der Zusammenarbeit zwischen medizinischen Einrichtungen, Ärzten und den Herstellern von Medizinprodukten beachtet werden sollten. Ergänzend enthält der "BVMed-Compliance-Standard" nun die organisationsbezogenen Aspekte.
