Pharmaceuticals pricing: Clifford Chance wins landmark ruling for GlaxoSmithKline at German Federal Social Court
The German Federal Social Court (BSG) has confirmed the common price-building practice between the pharmaceuticals industry and health insurance associations when introducing new medicinal drugs to the market. Prior to this judgment, the Regional Social Court of Berlin-Brandenburg had rejected the price-building as illegal, causing great uncertainty in the industry.
Since 2011, drug manufacturers and the central German health insurance association GKV have been negotiating prices of new medicinal products during the first year after these drugs have been approved to access the market. This common price-building method is based on a utility evaluation measuring whether a new drug offers additional benefits to patients compared to existing therapies. In case they do, a higher price could be negotiated than that charged for the existing therapy.
If the utility evaluation's results are mixed in the sense that an additional benefit of a new product can only be proven for certain patient groups, a so-called mixed price will be calculated. The new drug will then be available to all patient groups at this same mixed price, allowing all patients to benefit from the innovative drug even if they have not yet been able to prove an additional benefit, for example due to a limited set of analytical data available at this early stage of product marketing.
With its decision, the German Federal Social Court has overruled an earlier judgment of the Berlin-Brandenburg Regional Social Court that rejected the negotiation of mixed prices as illegal and ruled instead that new drugs may only be available to certain patient groups until their additional benefit for all patients has been proven.
Pharmaceutical industry and associations have greeted the BSG ruling, which has restored legal certainty and secures the right for all patients to have full access to innovative medicinal products.

Das Bundessozialgericht hat am 4. Juli 2018 die bisherige Praxis zur Bildung von Mischpreisen für neue Medikamente bestätigt. Diese Praxis hatte das Landessozialgericht Berlin-Brandenburg als Vorinstanz noch für rechtswidrig erklärt, was zu großer Verunsicherung in der Branche geführt hatte.
Seit 2011 handeln die Arzneimittelhersteller und der GKV-Spitzenverband die Preise neuer Medikamente im ersten Jahr nach der Zulassung aus. Basis ist eine Nutzenbewertung, bei der gemessen wird, ob das neue Medikament gegenüber einer gängigen Vergleichstherapie einen zusätzlichen Nutzen bringt. In diesem Fall kann ein höherer Preis verhandelt werden, als die Vergleichstherapie kostet.
Fällt die Nutzenbewertung in dem Sinne gemischt aus, dass nur für bestimmte Patientengruppen ein Zusatznutzen im Verhältnis zur Vergleichstherapie belegt werden kann, wird eine sogenannter Mischpreis gebildet. Zu diesem Mischpreis steht das Arzneimittel dann allen Patientengruppen zur Verfügung. Dies ist wichtig, weil viele Patienten von innovativen Arzneimitteln auch dann profitieren können, wenn diese einem Zusatznutzen im Verhältnis zur Vergleichstherapie auf Grund der begrenzten Datenlage noch nicht haben zeigen können.
Das BSG kassierte mit seiner Entscheidung ein Urteil des Landessozialgerichts (LSG) Berlin-Brandenburg, wonach Mischpreise rechtswidrig seien und stattdessen das Arzneimittel nur bestimmten Patientengruppen zur Verfügung gestellt werden dürfte.
Arzneimittelindustrie und Branchenverbände haben bereits positiv auf das Urteil reagiert, das die Rechtssicherheit wieder hergestellt hat und dem Patienten den Zugang zu innovativen Arzneimitteln weiter ermöglicht.
