European Union and Spain chapters in The Law Reviews' Intellectual Property and Antitrust Review 7th edition

27 July 2022

This seventh edition provides an update on recent developments, as well as an overview of the overall existing lay of the land regarding the relationship between antitrust and intellectual property laws and regulations.

Key topics include the constraints imposed by antitrust on licensing, the circumstances under which a refusal to license intellectual property rights can be unlawful, the imposition of antitrust obligations on owners of standard-essential patents, the application of antitrust law to cross-border e-commerce, the intense disputes regarding the application of antitrust law on patent settlements in the pharmaceutical industry, and the growing importance of intellectual property issues in merger cases.

Dieter Paemen is an antitrust partner at Clifford Chance LLP and the editor of the Law Reviews' Intellectual Property and Antitrust Review and author of the Preface and the European Union chapter.

Miquel Montañá Mora is also a partner at Clifford Chance and author of the chapter for Spain.

Below are the chapters for the EU and Preface, and for Spain, respectively.
