Limitations on the Scope of Investor-State Dispute Settlement under the United States-Mexico-Canada Agreement

On 30 September 2018, the United States, Mexico, and Canada announced their agreement on a replacement for NAFTA, which will be called the United States-Mexico-Canada Agreement (USMCA). This briefing discusses the prospective changes for the scope of investor-state dispute settlement envisaged under the USMCA framework, and certain of its limitations as compared to its predecessor, NAFTA.
