India’s New Approach to Investment Treaties

3 November 2016

Nish Shetty and Romesh Weeramantry explore India’s position in seeking to renegotiate its bilateral investment treaties in an article first published by the Asian Dispute Review.

Two significant developments have recently taken place in India’s investment treaty programme: the formulation of a new Model Bilateral Investment Treaty (BIT) and a policy aimed at terminating its old BITs.

These twin developments are part of a new phase in India’s approach to investment treaties which appears to have been triggered by numerous investment arbitrations filed against India.

The article surveys India's current BITs, the investment arbitrations filed against India and the content of India's new Model BIT. It concludes by assessing what effect the new Model BIT may have on India's future investment treaty negotiations.
