The European Commission and EU Member States have heightened the level of scrutiny and widened the regulatory net catching concentrative transactions and other investments in Europe, including through merger control, foreign direct investment (FDI) and foreign subsidies control. There has been an increasing trend, in particular, towards reforming FDI rules to shield strategic industries and businesses from opportunistic acquisitions by 'foreign' investors.

In this webinar, a multi-jurisdictional panel of speakers shared an overview of the importance of FDI and its interplay with other regulatory review procedures. We then discussed the EU framework for screening of foreign takeovers and investments, before hearing from panel members from France, Germany, Italy and Spain on specific FDI considerations relating to their respective jurisdictions.
