UK: Employment Update

17 May 2011

In this edition we look at the Government's consultation on Modern Workplaces and its proposals to introduce a new shared flexible parenting regime in 2015, to extend the right to request flexible working to all employees and its plans to clarify when statutory holiday may be carried forward to subsequent holiday years.

In addition we review an Employment Appeal Tribunal decision that illustrates that the preferential redundancy scoring of a maternity leaver amounts to impermissible sex discrimination. A second case considers the validity of compromise agreements when employees are referred to a panel of approved solicitors.

Finally, when an employment contract ends is considered in two cases: the first case examines the effect of a payment in lieu of notice; the second explores when written notice starts to run.
