Welcome to the April 2011 edition of Employment News in Brief.
In this edition we review the employment implications of the Budget and the changes being introduced in relation to HMRC's extra statutory concession on the payment of legal fees in connections with the termination of employment.
In one case reported this month we look at when the fairness of a final warning can impact on the fairness of a subsequent decision to dismiss and when an employment tribunal will go back over earlier disciplinary sanctions. This edition also reports on a case which explores whether the use of arbitration clauses can prevent an employee from pursuing claims before the employment tribunal by requiring any disputes to be resolved via arbitration.
Finally we look at decision of the European Court of Justice that provides guidance on what should be taken into account when determining what country's mandatory rules of law apply to the employment contract of an individual who has performed his work in a number of countries.
