EMIR 3.0: calculating the EU active account thresholds

EMIR 3.0 is changing the clearing thresholds under EMIR, which will also change the scope of application of the active account requirement (AAR) already introduced by EMIR 3.0. This briefing provides an overview of the planned changes to the clearing thresholds and the bases for calculating the thresholds relevant for determining whether and how the AAR applies and for the calculation of the related reporting obligation.

The Commission recently adopted the technical standards amending the clearing thresholds. These are subject to scrutiny by the European Parliament and the Council and the planned changes will enter into force 20 days after the technical standards are published in the Official Journal of the EU.
