Review of the EU Foreign Subsidies Regulation Still fit for purpose?

The European Commission has issued a report reviewing the first three years of implementation and enforcement of the Foreign Subsidies Regulation (FSR).

While the Commission considers that the FSR remains fit for purpose, it has identified room for improvement and is considering measures to address concerns raised by stakeholders. These include higher filing thresholds for M&A transactions; shorter filing forms for certain types of transactions; reduced information disclosure requirements; and annual or bi-annual filings for frequent filers under the public procurement filing regime.
