New EU FDI Screening Regulation to apply from 17 January 2028

The new EU FDI Screening Regulation has been published in the EU Official Journal, with a commencement date of 17 January 2028. It will apply to FDI transactions that close after that date, and which are not undergoing screening on that date.

The new Regulation will introduce various changes, including obligations for all member states to have mandatory and suspensory filing regimes covering a minimum scope of transactions, with call-in powers for non-notifiable deals. There will also be mandatory assessment criteria, shorter review timetables for some transactions and refinements to the procedure for cooperation between member states.
