Entwurf eines Dritten Gesetzes zur Neuregelung energiewirtschaftsrechtlicher Vorschriften
Am 29. Juli 2012 hat die Bundesregierung mit dem Entwurf eines Dritten Gesetzes zur Neuregelung energiewirtschaftsrechtlicher Vorschriften maßgebliche Neuerungen, insbesondere hinsichtlich der Regelungen zur Anbindung von Offshore-
Anlagen und zum Haftungsregime bei verspäteter Errichtung bzw. bei der Störung des Betriebs der Netzanbindung, eingebracht. Daneben sieht der Entwurf Folgeänderungen der Anreizregulierungsverordnung vor. Weitere Änderungen betreffen insbesondere die Freistellung von Speicherbetreibern von der Zahlung von Netzentgelten und die buchhalterische Entflechtung von Energieversorgungsunternehmen.
Draft Bill for the Third Act Revising the Legislation Governing the German Energy Sector
On 29 July 2012, the German government adopted the draft bill for the Third Act Revising the Legislation Governing the German Energy Sector which entails material amendments particularly in respect of the provisions regarding connecting offshore wind farms to the grid and a new liability regime for construction delays /disruptions to grid connection operations. The draft bill also contains follow-up amendments to the Incentive-based Regulation Ordinance. Further amendments relate, in particular, to the exemption granted to storage operators from payment of grid fees and accounting unbundling for energy supply companies.
