Clementine Packer

Clementine Packer is part of the International Arbitration Group. She specialises in cross border disputes, in particular between investors and States under bilateral investment treaties and free trade agreements, with a focus on the Energy & Resources sector. Her practice includes commercial arbitrations and related court proceedings, often involving State-owned enterprises and complex public policy issues. Clementine has experience with ICSID, ICC, UNCITRAL, and LCIA arbitrations, and has appeared before ICSID annulment committees and LCIA tribunals. She also advises investors on protection strategies in high-risk jurisdictions and states on investment promotion reforms. 

Clementine's experience includes high-profile investor-State disputes, complex litigation and international arbitrations, including:

  • Energy Transition Minerals in an ad hoc arbitration against the Governments of Greenland and Denmark regarding measures taken against the Kvanefjeld Technology Metals Project.
  • Kingsgate Consolidated Limited in an UNCITRAL arbitration against the Kingdom of Thailand under the Australia-Thailand Free Trade Agreement, the dispute concerning the alleged expropriation of the Chatree Gold Mine in northern Thailand.
  • Sundance Resources Limited and Congo Iron SA in an ICC investment arbitration against the Republic of Congo following the revocation of its mining licence for the Nabeba-Mbalam Iron Ore Project.
  • Sundance Resources Limited and Cam Iron SA in an ICC investment arbitration against the Republic of Cameroon following the government’s refusal to grant a mining permit for the Mbalam-Nabeba Iron Ore Project.
  • A large multinational corporation in parallel ICC arbitrations under supply agreements, with claims valued at multiple billions of USD.
  • A large multinational corporation in an arbitration defending claims brought by a State-owned company worth more than USD 100 million.
  • Two government-owned entities in a consolidated LCIA arbitration involving a sovereign wealth fund in relation to claims for multiple billions of USD.
  • Cortec Mining Kenya Ltd in an ICSID proceedings (arbitration and annulment) against the Republic of Kenya, arising out of the revocation of its mining licence.
  • Churchill Mining PLC in ICSID proceedings (arbitration and annulment) against the Republic of Indonesia, in relation to a mining project in Kalimantan.
  • A large multinational corporation in relation to delay and defects claims arising from three gas power projects in Saudi Arabia with claims valued at more than USD 100 million.
  • A multinational oilfield services in an ICC arbitration concerning the construction of a jetty for a major offshore LNG project in Australia with claims valued at more than USD 1 billion.
  • Various companies on investment protection strategies, including the availability of investment treaty protections, the standards of protection and complex jurisdictional issues.
  • A large oil and gas company on their options following major changes to a European offshore regulatory regime.
  • A government department on Brexit, including managing a broad review of all non-EU customs unions and the interaction between customs unions and FTAs.
  • Various companies on investment protection strategies in response to the UK Labour opposition's nationalisation proposals.
  • An Australian mining company in proceedings in the Supreme Court of New South Wales in relation to a USD 200 million political risk insurance policy.
