In this edition we provide an update on the revised "disguised remuneration" legislation, which was published on 31 March 2011. We recommend that companies operating share plans/bonus deferral arrangements through employee benefit trusts should seek advice now as to what steps to take to minimise the risk of tax charges under this new legislation.
In this newsletter we also highlight (1) some recent Budget announcements affecting employers (2) revised PAYE requirements for payments to ex-employees: some good news for employee share plans and (3) the latest UK developments in relation to the EU prospectus directive.
