Elbert advises on all stages of project development for renewable assets, with an emphasis on project finance and development.

Elbert has a particular focus on transactions involving renewable energy projects, including tax credit monetization (such as tax equity financings, flip partnerships and leases, and tax credit sales). Elbert provides guidance to clients with respect to investment tax credit qualification under Sections 48 and 48E and production tax credit qualification under Sections 45 and 45Y, among other incentives.

  • Represented tax equity term loan lenders in the $11B SunZia transaction, which was the largest financing of clean energy infrastructure in U.S. history at the time of financial close.*
  • Represented an investor in a tax equity investment of SB Orion, which was named PFI 2023 Renewables Deal of the Year and consisted of a 1.3GW portfolio of solar projects.*
  • Represented an investor in its approximately US$250 million tax equity financing of a 250 MW solar project.*
  • Represented an investor in a tax equity financing of a 593 MW solar project in Illinois.*
  • Represented three investors in a tax equity financing of a 500 MW solar project and adjacent 450 MW BESS.*
  • Represented two investors in a tax equity financing of a 408 MW solar project in Texas.*
  • Represented two investors in a tax equity financing of a 300 MW solar project in Arizona.*
  • Represented an investor in a tax equity financing of a 150 MW solar project in Arizona.*
  • Represented an investor in a tax equity financing of a 104 MW solar project in Pennsylvania.*
  • Represented an investor in a joint venture with a residential solar developer, including negotiation of the MPA, the joint operating agreement, and related contracts.*
  • Represented an investor in its approximately US$100 million tax equity financing of a residential solar portfolio.*
  • Represented two investors in a purchase of US$350 million investment tax credits.*
  • Represented a Fortune 100 Company in its purchase of US$150 million zero-emission nuclear power production tax credits.*
  • Represented a Fortune 100 Company in its purchase of US$100 million hydropower investment tax credits.*
  • Represented a Fortune 100 Company in its purchase of US$80 million investment tax credits.
