*Clifford Chance Asia is a Formal Law Alliance in Singapore between Clifford Chance Pte Ltd and Cavenagh Law LLP.
Jake is an Associate in the Disputes group at Clifford Chance, specialising in international arbitration and cross-border commercial disputes, with a particular focus on the energy, infrastructure and construction sectors.
He has experience acting in litigation and arbitration proceedings conducted under various rules, including disputes arising from major energy and infrastructure projects across Asia Pacific and other international markets. Jake specialises in claims concerning delay and disruption, defective works and variations on large-scale energy and infrastructure projects, as well as disputes involving contract termination, quantum, calls on performance bonds and other complex technical issues.
Jake also has considerable experience acting as project counsel and advising on project delivery and claims management strategies to proactively manage disputes, preserve commercial relationships and minimise the risk of formal dispute resolution proceedings. He also has experience negotiating and drafting construction and infrastructure contracts for a wide range of projects.
Jake has also acted in and advised on a range of commercial and defence sector related disputes.
Prior to relocating to Singapore, Jake practised in Australia, where he advised clients on a broad range of international and domestic disputes.
- Acting for a joint-venture owner in a UNCITRAL Rules arbitration against an EPC contractor regarding the engineering and construction of an oil refinery and petrochemicals complex in Malaysia.
- Acting for a contractor in an ICC arbitration against its consortium partner concerning delay and disruption claims in relation to the engineering and construction of a combined cycle power plant in Malaysia.
- Advising an Asian energy company on its rights and liabilities following the termination of construction contracts related to offshore wind farms in Asia, including advising on calls on performance bonds.
- Advising an Australian energy company in relation to breaches of an EPC contract in connection with a large onshore wind farm project on the East Coast of Australia.
- Advising an owner in respect of various project issues arising from the design and construction of a major plant upgrade project in Western Australia.
- Acting for an EPC contractor in an ICC arbitration against its consortium partner in connection with the engineering and construction of an onshore LNG storage facility in the Northern Territory of Australia.*
- Acting for a head-contractor in upstream and downstream ACICA arbitrations concerning delay, disruption and design‑related claims arising out of a major Australian rail project.*
- Acting for an Australian mine owner in a Resolution Institute Rules arbitration arising out of a construction and maintenance agreement for a coal mine project.*
- Acting for a property developer in Supreme Court proceedings to dissolve an injunction restraining it from having recourse to bonds provided as security under a contract for the design and construction of a high-rise apartment building in Brisbane: [2023] QSC 276.*
- Advising a foreign government on Australia's security of payment legislative framework.*
- Acting for a head-contractor in a series of adjudications, recovering c. AUD 100 million in claims in connection with a major freight and rail project in New South Wales.
