Mohsun Ali is a Senior Associate in the Dispute Resolution & Investigations Group in the Tokyo office of Clifford Chance and specialises in international commercial arbitration, investor-state dispute settlement and investigations.

Mohsun has a first-class honours degree in Japanese from the University of Cambridge and distinction class certification throughout law school. In 2019, Mohsun was admitted as a solicitor in England & Wales. Mohsun represents both Japanese and international clients on complex investment arbitration and commercial arbitration disputes across a broad range of sectors, including Construction, Energy & Infrastructure and Commodities. He routinely acts as advocate and conducts examinations before international tribunals.

Mohsun’s experience includes:

  • representing Sundance Resources Limited and Congo Iron SA in an ongoing ICC arbitration against the Republic of Congo following the revocation of its mining licence for the Nabeba-Mbalam Iron Ore Project (ICC Case No. 26145/DDA/AZO).
  • representing Sundance Resources Limited and Cam Iron SA in an ongoing ICC arbitration against the Republic of Cameroon concerning the Mbalam-Nabeba Iron Ore Project (ICC Case No. 26291/AZO).
  • representing Greenland Minerals Ltd in an ongoing arbitration against the Government of Greenland and the Government of Denmark regarding the right to develop the Kvanefjeld Technology Metals Project (ad hoc).
  • representing a Japanese industrial equipment manufacturer in an ICC arbitration in Singapore in relation to a major Southeast Asian infrastructure dispute related to low loss conductors and involving complex legal issues, quantum and delay analysis and structural engineering issues.
  • representing a JV in relation to a dispute in with regard to a Time Charter Party for a Floating Storage and Offloading System.
  • acting for a Japanese energy consortium in relation to a dispute arising out of the sale of offshore oil assets in West Africa and in relation to a consequential tax dispute, including in negotiations with the tax authority and the counterparty.
  • advising a Japanese trading house in relation to a shipping dispute with an Indian counterparty including claims arising out of the issuance of Force Majeure notices.
  • advising a major shareholder of a listed company in relation to a potential claim against host state.
  • advising a Japanese multinational in relation to its implementation of compliance systems and procedures.
  • representing a Japanese company in relation to a cyber-attack within Japan and consequential commercial disputes, regulatory aspects and engagement of e-commerce security experts in relation to cyber-security and IT issues.
  • assisting with advising a Japanese trading house on financial crimes due diligence in relation to the development of an energy project in Myanmar.
  • representing a consortium (including one Japanese trading house) in relation to a complex, cross border dispute in the energy sector.
  • advising a tech company on a potential dispute with client in relation to digital marketing services rendered. Involving complex issues of jurisdiction and contractual interpretation.
  • representing a multinational automobile distributor in a dispute with its Japanese principal in relation to a series of complex settlement arrangements totally around $170 million between the parties.
