ISDA and EMTA publish the 2026 FX Definitions: What you need to know now

The race to mine the seabed: Opportunities and risks

It is now almost trite to highlight the importance of critical minerals to the energy transition. The world's demand for critical minerals, including copper, cobalt, nickel and lithium, is soaring (with prices tipped to do the same). Less well known are the significant quantities of those minerals found deep in the ocean, lying on the seabed in the form of polymetallic nodules – small, solid, potato-sized balls of mineral-rich rocks. Over recent years, an area of the Pacific Ocean known as the Clarion-Clipperton Zone (CCZ), located between Mexico and Hawaii, has become the target of significant mineral exploration activities in this (until now) relatively unknown part of the earth.

Not surprisingly, the CCZ now lies at the heart of a geopolitical race to secure access to the metals needed to drive the energy transition forward. In this briefing we explore the significant opportunities – and risks – this race poses for investors.

Workplace Investigations – Quarterly Review – Edition 5

This Quarterly Review highlights that legislative changes and case law lessons globally are impacting the way in which employers conduct investigations. In particular, legislation is broadening the circumstances where employers are required to conduct robust workplace investigations.

In the UK, the forthcoming requirement to take all reasonable steps to prevent sexual harassment, the re-introduction of liability for third party harassment and the removal of the unfair dismissal compensation cap following the implementation of the Employment Rights Act 2025, all increase the importance of thorough investigations into potential workplace misconduct. The increase in focus on whistleblowing and whistleblower rights (such as in Spain where whistleblower protection is being strengthened and the UK where new anti-corruption strategy signals greater emphasis on whistleblowing and where refreshed guidance from the Serious Fraud Office ("SFO") underlines the importance of having a robust whistleblowing programs) is likely to have the same effect.

Whilst employers are under increasing pressure to investigate and address workplace conduct globally, we are also seeing a renewed focus on dealing with allegations of workplace misconduct pragmatically and proportionately. This underscores the importance of a considered triage stage: assessing whether an investigation is required at all, defining its scope, and deciding whether it should be handled internally or externally.

This triaging and planning stage is also an opportunity for employers to roadmap the investigation to ensure compliance with the increase in regulation and case law dictating the steps in the investigation process. This is the case in France where proposed new legislation creates a clear statutory framework for internal investigations, in Australia where careful planning is necessary to help maintain privilege in external investigations and in Singapore where the Workplace Fairness Act ("WFA"), expected in 2027, requires employers to update internal investigation protocols.

In the latest developments in the US, while government scrutiny of workplace DE&I programs continues to intensify, we are seeing courts push back against investigative demands that are overly broad or improperly used.

What happened at COP30?

While COP30 did not see any major breakthroughs in the official agreements reached, the Global Mutirão, which translates as "collective efforts", confirms key themes relevant to business, including the deployment of private capital in both mitigation and adaptation, and the importance of trade.

In this briefing we unpack the outcomes of COP30 in Belém, with a particular focus on what the negotiations mean for businesses, international climate financing and the voluntary carbon markets. As in previous COPs, at COP30 there was a focus on achieving a decision that all parties could agree to, a continuing challenge as that requires unanimity. The final text of the Decision, "Global Mutirão: Uniting humanity in a global mobilization against climate change," was agreed in the early hours of 22 November.

All aboard the Digital Omnibus? An overview of the EU's Digital Simplification Package

On 19 November 2025 the European Commission published the much-anticipated EU Digital Simplification Package. Also referred to as the "Digital Omnibus", the package is made up of two proposed omnibus laws:

a Regulation on the simplification of the implementation of harmonised rules on artificial intelligence (the "Digital Omnibus on AI"); and
a Regulation simplifying and consolidating parts of the EU's digital acquis, making targeted amendments to data, privacy and cyber laws ("Digital Legislation Omnibus").

The Digital Omnibus package is a pivotal step in the EU's push towards harmonising and streamlining its digital regulatory framework, including for AI, data access, privacy, and cybersecurity. Some of the key proposals relate to:

facilitating use of personal data in AI training, development and operation;
postponed entry into application for high-risk AI provisions, transitional periods for entry of certain transparency requirements for generative AI and targeted amendments to other EU AI Act provisions on oversight, AI literacy, documentation and registration;
consent fatigue and cookie rules;
codifying a subjective, entity-driven approach to the definition of personal data in the EU's General Data Protection Regulation (GDPR);
minimising the burden on controllers for certain data subject rights under the GDPR;
creating a single point for incident reporting under a number of EU laws, and increasing reporting thresholds and timeframes under the GDPR;
amending and consolidating key EU laws on data access and re-use; and
repealing the Platform-to-Business Regulation.

The text is likely to evolve as the proposals move through the legislative process. For businesses, this uncertainty and potential for shifting goalposts (including, potentially, unsettled positions close to the point at which certain obligations under the EU AI Act will begin applying) mean that thoughtful and strategic choices will need to be made regarding compliance preparations and possible policy engagement approaches.
