The European Commission has new powers to take action against distortive subsidies granted by non-EU countries, including those that affect M&A transactions and public tenders in the EU. Filing obligations for certain transactions have created extensive disclosure requirements for financial institutions and investors, both within and outside the EU, even if their dealings with non-EU countries are all on market terms.
