Join us for our Breakfast talk: Restructuring trends in Luxembourg and how to rescue distressed companies taking place on Thursday 30 November 2023 at Forum da Vinci.

Our team will provide insights into the new law on business preservation and modernisation of bankruptcy regime which came into force on 1 November 2023 and what it means for distressed companies but also their lenders and creditors more generally.

The aim of the new law is to prevent bankruptcies through the introduction of various reorganisation measures (in and out of court) to preserve the business which can be requested by a distressed company or in some cases, also by its creditors and interested third parties. The highlight of the new law is the introduction of a judicial reorganisation procedure which provides for a cross class cramdown. These new procedures will offer considerably more flexibility for businesses and we see already the first practical applications.
