The case of Good Harvest Partnership LLP v Centaur Services Ltd [2010], at the beginning of this year, unlocked a Pandora's box of issues surrounding the validity of lease guarantees. Commentators had hoped that, on appeal, a more commercial view would prevail. Unfortunately, the case has settled.
