As a result of the earthquake and subsequent tsunami in the Tohoku region of Japan on 11 March 2011, Fukushima Daiichi Nuclear Power Plant operated by The Tokyo Electric Power Company, Incorporated (TEPCO) sustained damage that has led to the release of radioactive materials.  In August 2011, the Japanese Diet approved and enacted the Nuclear Compensation Support Institution Law (the Law), which aims to support TEPCO in its obligations to compensate for the damage caused as a result of the nuclear accident.

Subsequently, the Nuclear Compensation Support Institution was established and it started its operation of sourcing funds, funding support to TEPCO and facilitating payment of compensation.  Further, the institution, together with TEPCO, submitted a Comprehensive Special Business Plan to the Japanese Government in order to obtain its support.  Approval of the plan was granted on 9 May 2012.

In our previous briefings entitled "Fukushima: Potential Nuclear Liabilities", "Fukushima: Proposed Governmental Support for TEPCO for Nuclear Liabilities" and "Fukushima: Enactment of Nuclear Compensation Support Institution Law", we discussed various issues relating to the liability of TEPCO arising out of the Nuclear Accident and the content of the Law.  This briefing will further discuss the operation of the Law and in particular the substantial nationalisation of TEPCO.
