Das Bundesministerium für Wirtschaft und Technologie (BMWi) hat am 10. November 2011 den Entwurf der 8. GWB-Novelle veröffentlicht. Der Entwurf basiert auf dem im August 2011 vorgestellten Eckpunktepapier des BMWi, welches die wettbewerbspolitischen Vorgaben aus dem Koalitionsvertrag zwischen CDU, CSU und FDP vom 26. Oktober 2009 umsetzt. Im Wesentlichen sieht der Entwurf eine weitere Angleichung des GWB an das europäische Fusionskontrollrecht vor. Die Novelle soll am 1. Januar 2013 in Kraft treten.

The Federal Ministry of Economics and Technology published the draft of the 8th amendment to the Act Against Restraints of Competition ("GWB") on 10 November 2011. The draft is based on the Federal Ministry of Economics and Technology's key issues paper introduced in August 2011, which implemented the guidelines on competition policy from the coalition agreement concluded by CDU, CSU and FDP on 26 October 2009. Essentially, the draft includes a further alignment of the Act Against Restraints of Competition with the European merger control law. The draft is to come into effect on 1 January 2013.
