In August 2011, China issued new provisions for its national security review system.

These provisions cover procedure and reflect MOFCOM's latest instructions on the process and timeline for submitting applications for national security review, and should be considered along with the State Council's notice of February 2011.

In this briefing, we cover the main features of both documents, and explain that the current legal framework still falls short of providing the much-needed detailed guidance on national security triggers for businesses.
