In the recent English case of Jivraj v Hashwani the English Court of Appeal considered an arbitration clause which required that "all arbitrators shall be respected members of the Ismaili community". It held that the clause was in breach of the UK's legislation prohibiting discrimination on grounds of religious belief in matters of employment, and the arbitration agreement was therefore unenforceable in its entirety.
