Clifford Chance successfully represents Symrise AG in the appelate proceedings against Stiftung Warentest

Clifford Chance has successfully advised Symrise AG in the revision to the injunction proceedings between Ritter Sport and Stiftung Warentest at the Court of Appeal in Munich.

Symrise AG was acting as an intervenor in the dispute. On 9 September 2014, the Court of Appeal in Munich confirmed the previous ruling handed down on 13 January 2014 by the District Court Munich.

Stiftung Warentest had been prohibited under a preliminary injunction of the District Court Munich dated 28 November 2013 from claiming that piperonal, a flavouring supplied by Symrise and used in Ritter Sport's "Voll-Nuss" chocolate, is allegedly chemically manufactured and does therefore not constitute a natural flavouring. Stiftung Warentest had objected to this ruling on points of law, but the objection had been rejected by the District Court on 13 January 2014. Subsequently, Stiftung Warentest appealed against this ruling before the Court of Appeal, but the judges confirmed the earlier ruling of the District Court. Stiftung Warentest thus continues to be enjoined from claiming that the flavouring piperonal is not a natural flavouring.

Clifford Chance vertritt Symrise AG erfolgreich im Berufungs-verfahren gegen Stiftung Warentest

Die internationale Anwaltssozietät Clifford Chance hat die Symrise AG als Nebenintervenientin erfolgreich bei dem Berufungsverfahren in dem einstweiligen Verfügungsverfahren von Ritter Sport gegen die Stiftung Warentest vertreten.

Das Oberlandesgericht München hat gestern das Urteil des Landgerichts München vom 13.1.2014 bestätigt.

Der Stiftung Warentest war mit einer vom Gericht am 28.11.2013 erlassenen einstweiligen Verfügung untersagt worden, zu behaupten, der in dem Schokoladenprodukt "Ritter Sport Voll-Nuss" enthaltene Aromastoff Piperonal werde chemisch hergestellt und sei damit kein natürliches Aroma. Hiergegen hatte die Stiftung Warentest Widerspruch eingelegt. Diesen Widerspruch hatte das Landgericht München am 13.1.2014 zurückgewiesen. Aber auch in dem von Stiftung Warentest angestrengten Berufungsverfahren schlossen sich die Richter dem Urteil an. Stiftung Warentest ist es damit weiterhin untersagt, zu behaupten, der Aromastoff Piperonal sei kein natürliches Aroma.
