Clifford Chance successfully advised Smartbook AG in trademark dispute before the Federal Supreme Court

Clifford Chance has advised Smartbook AG, Offenburg, in trademark proceedings before the First Civil Division of the Germany Federal Supreme Court (Bundesgerichtshof, BGH) in Karlsruhe. This Division is presided over by Prof. Dr. Dr. h.c. Bornkamm.

The proceedings before the Federal Supreme Court were related to the cancellation of four trademarks registered in the name of Smartbook AG ("smartbook" and "smartbook for smart people"). The Clifford Chance team which represented Smartbook AG in all stages of appeal comprised partner Dr. Claudia Milbradt and associates Anja Schwarz and Florian Reiling (all litigation, Düsseldorf). Federal Supreme Court lawyer Dr. Reiner Hall of the law firm Jordan & Hall, Karlsruhe, filled the role of legal counsel in the proceedings before the Federal Supreme Court.

In 2009, Qualcomm Inc., USA, represented by Hogan Lovells, filed an application for cancellation of the marks in dispute. Initially, the German Patent and Trademark Office (DPMA) ruled in favor of the applicant in all four cases. However, three of these decisions were then rescinded by the Federal Patent Court (Bundespatentgericht, BPatG) in February 2012, with the relevant applications for cancellation being dismissed.

In November 2012, Qualcomm Inc. filed an appeal on points of law against those decisions with the Federal Supreme Court. In the hearing held on 6 November 2012, the First Division of the Federal Supreme Court endorsed the decision issued by the Federal Patent Court and confirmed the legitimacy of the registration of the marks at issue.

After almost four years of continuous court proceedings the matter was finally decided in favor of Smartbook AG whose "smartbook" registrations have now been confirmed res judicata.

Parallel proceedings regarding the European registration of the trademark "smartbook" are currently pending before the Court of Justice of the European Union (EuG T-123/12). The oral hearing took place on 4 September 2013 in Luxembourg and it is expected that a judgment will be delivered shortly.

Clifford Chance vertritt Smartbook AG erfolgreich in Markenstreitigkeit vor dem Bundesgerichtshof

Die internationale Anwaltssozietät Clifford Chance hat die Smartbook AG, Offenburg, in einer markenrechtlichen Streitigkeit vor dem 1. Zivilsenat des Bundesgerichtshofs (BGH) in Karlsruhe vertreten. Den Vorsitz des Senats hat Herr Prof. Dr. Dr. h.c. Bornkamm inne.

Gegenstand des Verfahrens war die Löschung von vier streitgegenständlichen Marken ("smartbook" und "smartbook for smart people"), über deren Aufrechterhaltung der BGH in letzter Instanz zu entscheiden hatte. Das Team von Clifford Chance, das die Smartbook AG in allen Instanzen vertreten hat, bestand aus Partnerin Dr. Claudia Milbradt und den Associates Anja Schwarz und Florian Reiling (alle Litigation, Düsseldorf). Die Vertretung übernahm Dr. Reiner Hall, Rechtsanwalt am BGH, von der Kanzlei Jordan & Hall, Karlsruhe.

Im Jahr 2009 hatte die Qualcomm Inc., USA, einen Antrag auf Löschung der streitgegenständlichen Marken beim Deutschen Patent- und Markenamt (DPMA) eingereicht. Nachdem das DPMA in allen vier Fällen zunächst zugunsten der Qualcomm Inc. entschieden hatte, wurden drei der Beschlüsse des DPMA in dem sich anschließenden Beschwerdeverfahren vor dem Bundespatentgericht (BPatG) im Februar 2012 aufgehoben und die Löschungsanträge insoweit zurückgewiesen. Hiergegen wandte sich die von Hogan Lovells vertretene Qualcomm Inc. im November 2012 mit der beim BGH eingereichten Rechtsbeschwerde. Der erste Zivilsenat des BGH verwies in seiner mündlichen Verhandlung am 6. November 2012 jedoch auf die bereits ergangene Entscheidung des BPatG und führte aus, dass die streitgegenständlichen Marken zu Recht eingetragen worden seien.

Nach ungefähr vierjähriger Verfahrensdauer konnte damit ein Urteil zugunsten der Smartbook AG erwirkt werden, deren deutsche "smartbook"-Markeneintragungen damit als rechtsbeständig erteilt anzusehen sind.

Ein Parallelverfahren hinsichtlich der europäischen Markenanmeldung "smartbook" ist aktuell beim Gericht der Europäischen Union anhängig (Az: EuG T-123/12). Die mündliche Verhandlung vor dem EuG fand am 4. September 2013 in Luxemburg statt. Mit einer Urteilsverkündung wird in Kürze zu rechnen sein.
