Board Diversity Remains In The Spotlight

On August 6, 2021, the Securities and Exchange Commission approved the Nasdaq Stock Market’s Board Diversity Rule, which addressed board diversity disclosures and encouraged the creation of more diverse boards through a market-led solution. The same month, the Alliance for Fair Board Recruitment, along with the National Center for Public Policy Research, petitioned the U.S. Court of Appeals for the Fifth Circuit to invalidate the rule.
